Our legal framework designed to protect the community, the infrastructure, and you. Please read carefully.

  • 1. The Agreement: By using FruityHost, you agree to these legally binding terms.
  • 2. Static vs. Dynamic: Most accounts are Static (HTML/CSS/JS only). PHP is strictly reserved for "BoostedMax" users.
  • 3. Security Mandate: You must use Cloudflare DNS (Orange Cloud) to access our servers. Direct connections are blocked.
  • 4. Identity Verification: We may request ID verification via Stripe to prevent fraud. We do not store your ID.
  • 5. Zero Liability: The service is provided "As-Is". We are not liable for data loss or downtime.

1. AGREEMENT TO TERMS

These Terms of Service (the "Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and FruityHost ("we," "us," or "our"), concerning your access to and use of the FruityHost.com website as well as any other media form, media channel, mobile website, or related, linked, or otherwise connected thereto (collectively, the "Service").

By accessing the Service, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Service and you must discontinue use immediately.

2. NATURE OF SERVICE AND OPERATOR STATUS

FruityHost operates as a non-commercial, zero-profit initiative. We are an independent entity and are not affiliated with any commercial corporation. The Service is provided strictly on a gratuitous, "at-will" basis. We reserve the right to modify, suspend, or discontinue the Service at any time without notice or liability.

3. ELIGIBILITY AND REGISTRATION

By using the Service, you represent and warrant that:

  • (1) All registration information you submit is truthful, accurate, current, and complete;
  • (2) You will maintain the accuracy of such information;
  • (3) You have the legal capacity and you agree to comply with these Terms;
  • (4) You are not a minor in the jurisdiction in which you reside, or if a minor, you have received parental permission to use the Service (Note: Identity Verification requires users to be 18+);
  • (5) You will not access the Service through automated or non-human means, whether through a bot, script, or otherwise.

3.1 Identity Verification

We reserve the right to require identity verification via our third-party processor, Stripe Identity, at our sole discretion for security purposes. Refusal to comply with verification requests constitutes a material breach of these Terms and will result in immediate termination of your account. We do not retain biometric data or identification documents; such data is processed exclusively by Stripe.

4. TECHNICAL REQUIREMENTS AND NETWORK SECURITY

4.1 Mandatory Cloudflare Usage

To ensure network integrity and DDoS mitigation, you agree to route all domains associated with the Service through Cloudflare DNS. You must enable the "Proxy" status (Orange Cloud) for all A and CNAME records pointing to our infrastructure.

4.2 Direct Connection Prohibition

Direct connections to our origin server IP addresses are strictly prohibited and will be blocked by our firewall. Bypass attempts are considered a violation of our Acceptable Use Policy.

5. SERVICE TIERS AND COMMUNITY PERKS

The Service offers different resource tiers based on your support of our community infrastructure. These tiers are privileges ("Perks") granted to active Discord supporters and are not commercial products.

  • Standard Tier: Restricted to Static Content (HTML/CSS/JS). Storage cap: 100 MB. Available to all users.
  • Verified Tier: Restricted to Static Content. Storage cap: 1 GB. (Granted to users who complete Identity Verification).
  • Boosted+ Tier: Restricted to Static Content. Storage cap: 5 GB. (Perk for users contributing 1 Discord Server Boost).
  • BoostedMax Tier: Includes access to Dynamic Hosting (PHP & MySQL). Storage cap: 10 GB. (Perk for users contributing 2 Discord Server Boosts).

5.1 Mandatory Verification for Upper Tiers

Due to the increased storage and security risks associated with higher tiers, Identity Verification (via Stripe) is strictly mandatory for both the Boosted+ and BoostedMax tiers. Failure to maintain "Verified" status or active Server Boosts will result in the account being downgraded to the Standard Tier.

5.2 Resource Usage & PHP Policy

You agree not to use the Service in a manner that exceeds reasonable resource usage limits (CPU, RAM, I/O). PHP/MySQL access is strictly limited to the "BoostedMax" tier. Any attempt to bypass static restrictions on lower tiers is a violation of these Terms.

6. ACCEPTABLE USE POLICY (AUP)

You may not access or use the Service for any purpose other than that for which we make the Service available. Prohibited activities include, but are not limited to:

  • Cryptocurrency Mining: Usage of resources for blockchain verification or mining operations.
  • Malicious Content: Hosting malware, viruses, trojans, phishing sites, or exploit kits.
  • Illegal Activities: Any activity that violates applicable laws or regulations.
  • Adult Content: Hosting or distributing pornography or sexually explicit material.
  • Security Circumvention: Attempting to bypass the Cloudflare proxy requirement or accessing restricted server areas.

7. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Service is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Service (collectively, the "Content") are owned or controlled by us or licensed to us.

7.1 User Content

You retain full ownership of the data and files you upload to the Service. By uploading content, you grant us a limited, non-exclusive license to host, copy, and display said content solely for the purpose of providing the Service.

8. THIRD-PARTY INFRASTRUCTURE AND DATA PROCESSING

You acknowledge that the Service relies on third-party infrastructure providers, including but not limited to:

  • OVHcloud (France): Provision of physical server hardware.
  • Alpha Internet Limited (UK): Provision of "Fossbilling" automation software.
  • KeyHelp: Server control panel software.

Your data may be processed in jurisdictions other than your own. By using the Service, you consent to such transfer and processing.

9. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and defined following the laws of Sweden and the European Union.

9.1 Server Node Jurisdiction

Notwithstanding the foregoing, specific physical server nodes are subject to the local laws of their geographical location. Specifically, data residing on our web01-rbx node is subject to the laws of France.

10. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. LIMITATION OF LIABILITY

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
