1. First things first (The Definitions)
To make sure we are on the same page, here is what we mean when we say certain things:
- "Ground Rules", "Rules", "Contract": These all refer to this document (the Terms of Service). Whether we call it a rule or a contract, it is the same binding agreement.
- "Structure & Jurisdiction": We have no corporate structure. FruityHost is a fully independent, zero-profit project. We are not owned by any corporation, nor do we accept payments. However, our operations and servers strictly adhere to Swedish Law and German Law.
- "Us", "We", "FruityHost": The team running the servers and managing the website.
- "You", "The User": You, the person visiting our site or using our services.
- "The Service": The entire ecosystem. Please note our infrastructure is geographically split: the Website & Registration Records are located in England, while the Hosting Panel & Servers are located in France and the UK.
2. The Mission & Ownership (Heart & Soul)
FruityHost and FruityHost.com are fully owned and operated by Hadrian Ek. We operate strictly as a Zero-Profit project with a clear mission: to make the internet accessible to everyone, regardless of their financial situation.
This initiative is fueled by love and kindness, not profit. While we strive to provide a premium quality service that rivals paid hosts, please remember that Hadrian Ek and the entire FruityHost team work on this project entirely in their free time as a dedicated hobby. We do it because we care.
3. How this Agreement Works
This page (and any documents we link to) tells you the ground rules. Please read them carefully before you start using any of our free services.
Here is the deal: By creating a free account (Ordering a free webhosting account) or using our services, you are agreeing to be bound by these Terms. If you refuse to accept these Terms, you unfortunately cannot create an account.
Tip: You should probably print a copy of this for your records, or just bookmark it.
4. Who can join? (Eligibility & Requirements)
To use our free services, you must be able to truthfully say "Yes" to the following:
- You have read and understood these Terms. (You didn't just scroll to the bottom).
- You are legally capable of entering into binding contracts.
- You are at least 18 years old. (Strict requirement for our ID verification process).
- All personal information provided during signup is accurate and complete. (Fake names or details will fail verification).
- You understand that this is a free service provided free of charge and operated by the kind team of FruityHost in their spare time (Which is a lot of spare time).
5. Third-Party Services (ID & Community)
To keep our platform safe and functioning, we rely on trusted third-party partners. By using FruityHost, you agree to their terms as well.
- Stripe Identity (Verification): We utilize Stripe Identity to securely verify that you are a real human. We do not store your ID documents on our servers; they are processed securely by Stripe. By verifying, you agree to Stripe's Terms of Service.
- Discord (Community & Support): Our community and support systems live on Discord. By joining our server or using our support channels, you acknowledge and agree to be bound by Discord's Terms of Service and Community Guidelines.
6. Cost & Availability (The "Free" Part)
Let's be crystal clear: No currency is exchanged when you use FruityHost. We do not charge fees, and we do not sell premium plans.
Because this service is provided completely free of charge:
- Best Effort Basis: We offer this service on a "best effort" basis. This means we try our hardest to keep things running, but we make no guarantees about uptime or speed.
- Volunteer Run: This project is maintained by us during our free time (when we aren't working our day jobs or sleeping). Support responses may not be immediate.
7. The Specs & Limitations (Static Only)
FruityHost provides a specific environment for specific needs. Please understand our technical limitations before applying:
Static Web Hosting (Shared Environment):
We provide a Shared Hosting environment optimized strictly for Static Content. This means:
- Allowed: HTML, CSS, JavaScript (Client-Side), Images, Fonts.
- NOT Allowed: PHP, Python, Ruby, Node.js, Perl, or any server-side scripting.
- No Databases: We do not offer MySQL, PostgreSQL, or other database services.
- Shared Resources: You share the server with other users. Excessive resource usage that impacts neighbors is not allowed.
Resource Limits:
- Storage: Default 100 MB. (Max requestable: 1 GB).
Note: If we detect that a site exceeds 75 MB, we reserve the right to audit storage usage and may require ID verification to ensure fair use. - RAM: Shared allocation.
- vCPU: Shared allocation.
The Engine (Hardware Specs):
We don't run on potatoes. Our servers are high performance and they scale according to our needs. We can't say exactly what specs we run on as it differs from location to location and varies a lot. But we run up to 128 GB RAM per server and high-speed NVMe storage in RAID 10.
⚠️ The Truth about Backups (RAID vs. Reality)
We use RAID technology as a failsafe. However, please understand:
- RAID is NOT a Backup: It does not protect against fire, flood, or you accidentally deleting your own files.
- We do NOT backup your data: As a free service, we do not perform automatic backups for users. Your data is your responsibility.
- Always download your backups to your own computer if the data is important.
Fair Usage & Limitations:
- No Video Hosting: We are a web host, not a streaming service. Video files and streaming features are disabled. Please use YouTube or a CDN.
- No Large File Storage: If you need to store massive files, please use a dedicated storage service.
8. Security (The Fortress)
Security is a two-way street. Here is what we do, and what we expect you to do:
- Your Password: We recommend using strong, complex passwords that you haven't reused from 2012. You are responsible for keeping your account details safe.
- Our Updates: We regularly patch and update our servers and the hosting control panel to keep everything secure.
- Encryption & Cloudflare: We use SSL encryption (the padlock) everywhere, and our website runs behind Cloudflare for an extra layer of speed and protection.
- Anti-DDoS: We provide Anti-DDoS protection on a "best effort" basis. For security reasons, we can't disclose our exact mitigation capacity, but let's just say it's pretty high 😉.
- Internal Security: We practice what we preach. Team members with access to sensitive areas are strictly required to use Two-Factor Authentication (2step verification) and strong passwords.
9. Data Protection & GDPR (Your Secrets are Safe)
We follow all EU and GDPR laws strictly. We perform regular internal audits to ensure our systems are secure. Here is what happens in the unlikely event of a breach:
- The Protocol: Should we discover a breach, we are legally required to notify the Swedish Authority for Privacy Protection (IMY) within 72 hours of discovery. We will also notify users as soon as it is safe to do so (depending on instructions from authorities).
- Your Data: If our internal registration records are breached, personal info like your Name, Address, and Phone Number could potentially be exposed. However, your Passwords are hashed and encrypted in the database—hackers cannot read them.
- ID Documents: Since we use Stripe for verification, we do not store any ID documents on our servers. Your ID data remains safe with Stripe.
- Server Hardening: Our servers in the United Kingdom and France are hardened. Connecting to them requires passing through specific network loops and strict access controls. It is not easy to get in.

10. Changes to these Terms
We reserve the right to update or modify these Terms from time to time. Every time you use our services, please check these Terms to ensure you understand the rules that apply at that time.
11. The "Rotten Apple" Policy (Acceptable Use)
We are pretty chill, but we have zero tolerance for "Rotten Apples." You agree NOT to use FruityHost for:
- Crypto Mining: No Bitcoin, Monero, or any other coin mining. It kills our CPU.
- Phishing & Fraud: If you try to steal grandmas' bank passwords, we will ban you instantly.
- Malware: Hosting viruses, trojans, or exploit kits.
- Adult Content: Keep it PG-13. We are not that kind of host.
- Dynamic Scripts: Attempting to bypass static limitations to run server-side scripts is prohibited.
12. Legal Compliance & Copyright (The Serious Stuff)
We collaborate closely with our datacenter partners and legal authorities to maintain a safe network. Here is how we handle violations:
- Cooperation with Authorities: If we notice any activity that breaks the law, we are obligated by law to report it. Depending on the severity, we will forcefully remove the content and permanently suspend the user without warning.
- Copyright Complaints (DMCA): If we receive a valid copyright complaint about your site:
- We will notify you and ask you to remove the content.
- You have 24 hours to respond or remove the files.
- If you do not respond within 24 hours, we will pause your account.
- If no response is given after 72 hours, your account will be terminated.
- Repeated copyright offenses will result in immediate termination.
13. Resource Usage (Don't Hog the Water)
FruityHost is a shared environment. That means you are sharing the server with other students and developers. If your site uses excessive CPU or RAM that slows down the server for everyone else, we may have to suspend your site to keep the servers healthy.
14. Intellectual Property (Who Owns What?)
It's simple: we own our house, you own your furniture.
- Our Stuff (FruityHost / Hadrian Ek): All content, features, and functionality of FruityHost.com (including the logo, design, and code) are the exclusive property of FruityHost and Hadrian Ek and are protected by intellectual property laws. Please don't steal our stuff.
- Your Stuff: You retain full ownership of your website content. By using our service, you grant us a limited, worldwide license to host, copy, and display your content solely for the purpose of providing the Service. We don't claim ownership of your work.
15. Termination & Enforcement Rights
We prefer to be nice, but to protect the integrity of the orchard, FruityHost reserves the right to:
- Suspend or terminate accounts for any violation of these Terms.
- Block IP addresses and domains associated with abuse or malicious activity.
- Blacklist users who have demonstrated a pattern of abuse.
- Terminate services without prior notice for violations.
16. Liability & Disclaimer of Warranties (The "As-Is" Clause)
We provide this service for free. While we work hard to keep everything online and secure, FruityHost is provided "AS IS" without warranties of any kind, either express or implied. By using the service, you agree that we are not liable for:
- Uninterrupted Service: We do not guarantee 100% uptime. The server might go down for maintenance or if a squirrel chews a cable.
- Error-Free Operation: Bugs happen. We fix them when we can, but we don't promise perfection.
- Fitness for a Particular Purpose: Do not use this service for mission-critical applications (like running a hospital or a bank).
- Data Retention: We are not a backup service. We are not liable for any data loss.
- Encryption Effectiveness: While we provide tools like SSL, it is your responsibility to properly enable and use them.
In short: Don't sue us if things break. We are doing our best.
17. Communication & Resolution (How to Reach Us)
Since we are a small, volunteer-run team, we need to be efficient with our communication. Please use the correct channel for your needs:
- General Support & Chat: For help with your website, account issues, or just to say hi, use our Discord Server or email support@fruityhost.com.
- Legal Inquiries: If you have a formal legal question, copyright issue, or need to send a legal notice, you MUST email legal@fruityhost.com. Legal notices sent via Discord or general support may be missed and deemed invalid.
- GDPR & Data Privacy: For data processing requests, data deletion, or privacy concerns, please contact our Data Protection team at dpa@fruityhost.com.
- Response Times:
- Support: Usually within 24 hours (This is our goal, not a binding promise).
- Legal Inquiries: Within 72 hours.
- GDPR/DPA Requests: Within 30 days (as required by law).
- Language: To ensure we can help you, all initial service communication must be in English.
- Zero Liability Limit: As a free service provided at no cost, the maximum financial compensation for any claim is limited to $0 (Zero).
- Dispute Resolution: If you have an issue, please talk to us. We will make the final decision on service-related disputes, but we promise to be fair and listen to your side.
18. Governing Law & Mandatory Dispute Resolution
We want to solve problems, not create them. By using FruityHost, you explicitly agree to the following resolution process:
- Step 1: Mandatory Informal Resolution: Before you can file any legal claim or lawsuit against FruityHost or Hadrian Ek, you MUST first attempt to resolve the dispute informally by contacting legal@fruityhost.com. We will work with you in good faith to resolve the issue. You agree that you cannot begin any legal proceedings until at least 60 days after sending this notice.
- Step 2: No Class Actions: You agree that you may resolve disputes with us only on an individual basis. You explicitly waive your right to bring a claim as a plaintiff or a class member in a class, consolidated, or representative action.
- Step 3: Governing Law & Venue: If a dispute cannot be resolved informally, these Terms shall be governed by the laws of Sweden. Any judicial proceedings must be brought in the competent courts of Sweden.
- Legal Fees & The Reality of Free Services: If this sadly goes to court, you agree to bear your own legal costs and attorney fees. Also, please remember: 0 multiplied by anything is still 0. Since you paid nothing for the service, the financial damages awarded by a court would likely be non-existent. It would just be a waste of everyone's time.
